A Sole Agency commission of 1.95% or Multiple Agency commission of 2.95% of the eventual sale price of the property payable in the event of our introducing an applicant who enters into a binding contract to purchase. (Sale price means the price which the price which the purchaser contracts to pay or if you should exchange/part exchange your property with the purchaser, the agreed value of the property).
The commission becomes due on exchange of contracts with the purchaser and will be subject to the addition of Value Added Tax at the prevailing rate and is inclusive of all fees and expenses. This means that you will not have to pay any further sums in addition to the above percentages of the sale price, unless agreed and itemized in writing.
We intend to offer any prospective purchaser financial services in the form of mortgages or other financial services as may be required and appears appropriate. It is likely we will earn commission from the insurance company or mortgage lender if we are successful in providing financial services. There will be no cost to you, and it should benefit the progress of your sale if we can arrange the finance to purchase through Heritage Estates. We may also act in the sale of your own property for which a commission is likely to be earned.
If we are at any stage appointed Sole Agents in the sale of your property, either by you favouring us specifically or Multiple Agency instructions, or by you withdrawing instructions from other agents who may be instructed, we are required to advise you in the following terms by law:
Sole Agency You will be liable to pay renumeration to us, in addition to any other costs or charges agreed, if at any time unconditional contracts for the sale of your property are exchanges with a purchaser introduced by us during the period of our sole agency or with whom we had negotiations about the property during that period, or with a purchaser introduced by another agent during that period.
Board Heritage Estates will/will not erect a For Sale Board to further promote the sale of the property also required to point out that in the event we have your authority to erect a For Sale Board under the act restricting the size and number of boards, it is not permitted for more than one board to be displayed at any time, and that you will be liable for prosecution if the erection of a second advertisement is permitted.
In the event of The vendor(s) introducing a private purchaser, the vendor(s) will immediately inform Heritage Estates of the name and address of such purchaser and provide such other information Heritage Estates may reasonably require for the purpose of checking that no fee is due to them.
Variance of terms Any change from Sole Agency to Multiple Agency, or vice versa, or cancellation of this must be confirmed in writing to Heritage Estates with 14 days notice in writing. The Estate Agents Act 1979 requires a declaration if the vendor(s) is related, however remotely, to any staff member or associate of Heritage Estates.
VARIATION OF OUR COMMISSION RATES IS SUBJECT TO INDIVIDUAL NEGOTIATION.

Terms & Conditions for Full Management
OUR TERMS OF BUSINESS ARE: Heritage Estatesare instructed as Sole/Multiple Letting Agent for a minimum period to be negotiated at a monthly rental to be negotiated
An Assured Shorthold Tenancy is required for a minimum period being six months.
The Landlord agrees to pay a Letting Fee of £100 plus VAT towards advertising the property, Tenant selection, taking up and checking references, drawing up the Assured Shorthold Tenancy Agreement, and checking the Tenant into the property, receiving the first month's rent, receiving the deposit as agreed, and at the conclusion of the term, checking the tenant out of the property and returning or adjusting the deposit to account for breakages or dilapidations as agreed.
In addition the Landlord agrees to pay 12.5% of the gross monthly rental plus VAT to administer the Tenancy throughout the term including the collection of rents and accounting to the Landlord.
The Landlord will be liable to pay the above fees to the Agent if at any time an Agreement is entered into with a Tenant introduced by the Agent during the period of the agreed Agency or with whom the Agent had negotiations during that period. Also, if an agreement to let is made after the expiry of this agreement to a party introduced during the term of the Agency, the full fees are payable.
The Landlord agrees to pay a fee of £50.00 plus VAT for the preparation and administration of a new Tenancy Agreement, when due to existing tenant.
It is understood that no party is at present negotiating to rent the property and that no introduction has been made by any other party.
In the event that the Tenant introduced by the Agent purchases the property, then the Landlord will be liable to pay the full Estate Agency commission of 1.95% of the Sale Price plus VAT with a minimum of £1,500 plus VAT.
All installations for gas, electricity and water must be maintained by the Landlord in good repair. Gas and Electrical appliances must be regularly serviced and maintained in safe working condition. Unless caused by the Tenant's neglect, all breakdowns of appliances must be dealt with promptly by the Landlord. The Agent will deal with the repair and maintenance contractors after contacting the Landlord for authority for expenditure. It is usual that the Agent has authority to order urgent repairs up to a maximum expenditure of £75.00 if the Landlord is unable to be contacted or is not resident in the United Kingdom. In all other cases estimates will be obtained for the Landlord's approval if required before expenditure is approved.
If required the Agent will prepare an Inventory on the terms laid out in our Management Charges leaflet.
It is the Landlord's responsibility to maintain, repair and secure the Property if it is unoccupied.
It is the Landlord's responsibility to inform the Insurers of the property of the intention to Let.
It is the Landlord's responsibility to obtain permission from the Mortgage Lender (where appropriate) to Let the property.
HERITAGE ESTATES will in no way be held liable or responsible for any damage or deficiency, material or financial, howsoever caused.

Terms & Conditions Let Only Instruction
OUR TERMS OF BUSINESS ARE: Heritage Estatesare instructed as Sole/Multiple Letting Agent for a minimum period to be negotiated and the said instruction will continue until terminated in writing with a notice period of not less than fourteen days by either the Landlord or the Agent.
An Assured Shorthold Tenancy is required of (to be negotiated) months (the minimum period being six months).
The Property will be marketed initially to achieve a monthly rental of (to be negotiated).
The Landlord agrees to pay a Letting Fee equivalent to one month's rental plus VAT towards advertising the property, Tenant selection, taking up and checking references, drawing up the Assured Shorthold Tenancy Agreement, checking the Tenant into the property, receiving the first month's rent and receiving the deposit as agreed.
The Landlord agrees to pay a fee of £50.00 plus VAT for the preparation and administration of a new Tenancy Agreement when due to existing tenant(s).
A further fee of the equivalent of half of one month's rent plus VAT will be payable for the introduction of another tenant, if required, within the first year.

Also, if an agreement to let is made after the expiry of this agreement to a party introduced during the term of the Agency, the full fees are payable.
